Article 1 – Purpose

These Terms and Conditions of Sale (“T&Cs”) govern all sales concluded between KAIRO Pets (hereinafter referred to as “KAIRO” or the “Seller”) and any individual or legal entity purchasing products through the KAIRO Pets website (hereinafter referred to as the “Customer”).

They define the rights and obligations of each party in relation to the online sale of the products offered on the website.

Placing an order constitutes full and unconditional acceptance of these Terms and Conditions of Sale.

Article 3 – Products

The products offered for sale are presented with the utmost care.

Photographs, illustrations, and descriptions are intended to represent the products as accurately as possible.

However, slight differences in color, texture, or finish may occur depending on the screen used or manufacturing developments, without affecting the essential characteristics of the product.


Article 4 – Availability

Products are offered subject to availability.

In the event of exceptional unavailability after an order has been confirmed, the Customer will be informed as soon as possible.

The Customer may then choose:

  • a full refund;
  • or, where possible, an equivalent product.


Article 5 – Prices

The prices displayed on the website are expressed in the currency selected by the Customer.

Any applicable shipping costs are displayed before the final confirmation of the order.

KAIRO reserves the right to modify its prices at any time.

The applicable price is the one displayed at the time the order is confirmed.


Article 6 – Orders

The Customer selects the products they wish to purchase and adds them to their shopping cart.

Before completing the order, the Customer is responsible for verifying:

  • the selected products;
  • the quantities;
  • the delivery address;
  • the billing information.

The order becomes final once payment has been confirmed.

An order confirmation is then sent by email.

 

Article 7 – Payment

Payment is due immediately upon placing the order.

Payments are securely processed through the payment partners available on the website.

KAIRO never has access to customers’ complete banking information.

If payment is declined by the customer’s financial institution, the order will be automatically canceled.


Article 8 – Delivery

The terms governing order preparation, shipment, and delivery are detailed in our Shipping Policy, available on the website.

The Customer acknowledges having read this policy before completing their order.


Article 9 – Right of Withdrawal

Where the Customer meets the conditions provided by applicable law, they benefit from a period of fourteen (14) days to exercise their right of withdrawal.

Article 10 – Returns and Refunds

Requests for returns, refunds, or exchanges are handled in accordance with our Refund & Return Policy.

No return will be accepted without prior authorization from our customer service team.


Article 11 – Legal Guarantees

Consumers benefit from the legal guarantees provided by applicable law, including:

  • the legal guarantee of conformity;
  • the warranty against hidden defects.

These legal guarantees apply independently of any commercial warranty that may be offered.

 

Article 12 – Liability

KAIRO shall not be held liable for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to:

  • natural disasters;
  • strikes;
  • labor disputes;
  • pandemics;
  • wars;
  • government decisions;
  • disruptions to transportation networks;
  • or any other event of force majeure.


Article 13 – Intellectual Property

All content available on the KAIRO Pets website (including text, photographs, illustrations, logos, visual identity, videos, graphic elements, and design) is protected by applicable intellectual property laws.

Any reproduction, representation, distribution, or exploitation, in whole or in part, without prior written authorization is prohibited.


Article 14 – Personal Data

The personal data collected are processed in accordance with our Privacy Policy.

In particular, the Customer has the rights of access, rectification, erasure, restriction of processing, objection, and data portability under the conditions provided by applicable legislation.


Article 15 – Governing Law and Dispute Resolution

These Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the parties shall endeavor to reach an amicable settlement.

Failing an amicable resolution, jurisdiction shall lie with the competent courts designated by the applicable legal provisions.
